Harare magistrate Ngoni Nduna has upheld the State’s decision to deny Zimbabwe Mining Federation president, Henrietta Rushwaya, bail.
In the initial appearance, the State had consented to bail but changed its decision on Wednesday after new circumstances arose in the case.
Besides possession of 6kg of gold, she now stands accused of bribery for attempting to entice officials who arrested her with US$5 000 to release her.
“The State’s reasons for withdrawal are plausible and there was no need for an affidavit to be tendered before the court during the withdrawal.
“Withdrawal is allowed and full submissions relating to bail should be placed on record,” ruled Nduna.
In his ruling he said the defence led by Tapson Dzvetero failed to enumerate the likely prejudice that might affect Rushwaya if the consent was withdrawn and remained silent over the issue.
After the ruling, Garudzo Ziyaduma from the National Prosecuting Authority made an application to join Rushwaya with six other accomplices related to the matter who have since been arrested.
