You Remain On Remand…Case Is Of National Interest, Magistrate Tells Nguwaya

Draxgate scandal front man and controversial businessman Delish Nguwaya’s bid to be removed from remand flopped after senior Harare regional magistrate Trynos Utahwashe turned down his aspirations.

Through his lawyer, Admire Rubaya, Nguwaya had approached the court seeking to be removed from remand as over five months have elapsed without the State setting a trial date.

The State led by Michael Reza had promised to avail a trial date within a month after his arrest but no action has taken place since then serve for postponements.

Reza submitted that the docket is at the court but there were more investigations that the police needed to carry out to complete the case.

“The docket was returned to court but police still need to make extra-territorial investigations hence the State cannot give a trial date until these investigations are complete,” he said.

Magistrate Utahwashe ruled that Nguwaya remain on remand, further stating that five months was not a long period as everyone is aware of the difficult working conditions that were posed by the Covid-19 restrictions.

“This is a complex matter of national importance that needs to be investigated fully. Five months is not a long time and the circumstances of a case determine the length of remand. The Covid-19 restrictions have made working conditions difficult, and everyone is aware of this,” he said.

The matter was remanded to December 1, 2020 for routine remand. Nhau/Indaba
