Zimbabwe Miners Federation (ZMF) president Henrietta Rushwaya will spend the night in custody for being caught smuggling gold at Robert Mugabe lnternational airport in Harare yesterday.
The State represented by Charles Muchemwa had consented to her being granted bail on a proposal of depositing $90 000 to the clerk of court.
Harare magistrate Ngoni Nduna told both the State and Defence led by Tapson Dzvetero that it was unfair for both of them to come to court on consent for the granting of bail without facts supporting their consent.
“The court cannot be rubber stamped into giving a decision without facts on the basis of the consent.”
“The value involved on the case must be considered hence parties must present themselves tomorrow at 9:00am with facts supporting the basis of their consent,” he said. Nhau/lndaba
